- this DR is wrong the licence PD-1923 states that photos taken BEFORE 1923 ANYWHERE are in PUBLIC DOMAIN in the United States. All the above photos are taken in the 1900s-1910s. Regards, --Elisa Rolle 12:44, 14 February 2018 (UTC)
- BTW see what is written in the RITA MARTIN page on Wikimedia "Works of this artist first published before 1923 can be uploaded to English Wikipedia (see en:Template:PD-US-1923-abroad). For more information, see Commons:Licensing and Commons:Derivative works." So why there is a DR on this photos? --Elisa Rolle 12:47, 14 February 2018 (UTC)
- @Elisa.rolle: it’s not when the photos were taken that counts for PD-1923, but when they were published. Moreover Commons (unlike enWP) requires media to be free in both the USA and the country of origin. In this case it would appear the photographer’s estate or heirs will hold UK copyrights until 2029.—Odysseus1479 (talk) 20:45, 14 February 2018 (UTC)
- Gladys Cooper, Lily Brayton and Lily Elsie were taken as publicity postcard for their works as actresses, and published in the 1900s-1910s. Rosamund Massy was taken as a private card (they were the old version of the visit card of today) back when she was a suffrage movement leader in the 1910s. The self-portrait was done as promotional material of her work. All published way before 1923. And I think there is even a specific rule somewhere about publicity works, but at this point I do not have time to search for it. The notice: "Works of this artist first published before 1923 can be uploaded to English Wikipedia (see en:Template:PD-US-1923-abroad). For more information, see Commons:Licensing and Commons:Derivative works." is on Wikimedia, not Wikipedia. How you can upload a work on "English Wikipedia" without passing from Wikimedia? if there is a way, please move the photos on Wikipedia; if not proceed deleting them. I have already decided I do not want to collaborate with Wikimedia and Wikipedia anymore, therefore I will not follow this topic anymore. Follow-up on the above DR by Mutter Erde, remaining images in the category. These are all UK works by English photographer Rita Martin who died in 1958. 70 years p.m.a. applies, can be undeleted in 2029. Also, it's possible to upload these images locally to English-language Wikipedia per their local policy.

- I guess one question would be whether these images were also published in the United States before 1923--if they were, they're out of copyright for our purposes, no matter when the photographer died, is that correct? - Penny Richards (talk) 21:59, 1 March 2018 (UTC)
- Ah, no, this is the line in the template: "Public domain works must be out of copyright in both the United States and in the source country of the work in order to be hosted on the Commons. If the work is not a U.S. work, the file must have an additional copyright tag indicating the copyright status in the source country." So yeah, I guess they have to be deleted until they're free in the UK too. Penny Richards (talk) 22:08, 1 March 2018 (UTC)
